Terms of Service

1. The service

MyClubControl is a software-as-a-service platform that helps clubs and organizations manage members, chapters, events, dues, communications and related activities. We may add, change or remove features over time.

2. Accounts

You must provide accurate information and keep your credentials secure. You are responsible for activity under your account. Two-factor authentication is available and recommended for administrators. Notify us promptly of any unauthorized use.

3. Acceptable use

You agree not to:

• Use the service unlawfully or to infringe the rights of others;
• Upload content that is illegal, harmful, or that you lack the right to share;
• Attempt to breach security, access data that isn't yours, or disrupt the service;
• Resell or misrepresent the service, or use it to send unsolicited messages.

4. Subscriptions and billing

Paid plans are billed in advance through our payment processor (Stripe) on a recurring basis until cancelled. Plan limits and prices are shown at sign-up and in your billing settings. You may cancel at any time; cancellation takes effect at the end of the current billing period, and fees already paid are non-refundable except where required by law. We may change prices with reasonable notice.

5. Your content and club data

You retain ownership of the data and content you or your members submit (“Club Data”). You grant us a limited licence to host, process and display Club Data solely to operate and improve the service. You are responsible for having the necessary rights and consents for the Club Data you provide, including personal information about your members. Our handling of personal data is described in our Privacy Policy.

6. Intellectual property

The MyClubControl platform, including its software, design and trademarks, is owned by Trinity Commerce LLC and its licensors. These Terms grant you no rights to our intellectual property other than to use the service as permitted.

7. Third-party services

The service relies on third-party providers (for example hosting, payments, email and messaging). Their availability and terms are outside our control, and your use of certain features may be subject to their terms.

8. Termination

You may stop using the service and close your account at any time. We may suspend or terminate access if you materially breach these Terms or use the service in a way that risks harm to others or to the platform. On termination you may request an export of your Club Data as described in the Privacy Policy.

9. Disclaimers

The service is provided “as is” and “as available”, without warranties of any kind to the fullest extent permitted by law. We do not warrant that the service will be uninterrupted or error-free.

10. Limitation of liability

To the fullest extent permitted by law, Trinity Commerce LLC will not be liable for indirect, incidental, special or consequential damages, or for lost profits or data. Our total liability for any claim relating to the service will not exceed the amounts you paid to us for the service in the twelve months before the claim.

11. Indemnification

You agree to indemnify Trinity Commerce LLC against claims arising from your Club Data, your use of the service, or your breach of these Terms.

12. Governing law

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-law rules. Disputes will be subject to the courts located in that state, unless otherwise required by applicable law.

13. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by an updated effective date, and where appropriate we will provide additional notice. Continued use after changes take effect constitutes acceptance.
